The Denial Is Now Final

The 30-day window for Heritage Group (US Aggregates) to appeal the Allen County Board of Zoning Appeals’ 4–0 denial to an Allen County court expired on June 25, 2026. No appeal was filed.

The BZA’s decision stands as a final, uncontested zoning record. Under Indiana law, Heritage Group must now wait approximately one year before refiling the same or substantially similar special use variance application.

The Community Celebrated the 4–0 Denial

The turnout was a reminder of how wide and deep this community’s commitment runs. Thank you again to every person in that room, and to every person who was part of this effort in any way.

And Now: The Appeal Window Has Also Closed

We can now report that the celebration was warranted on both counts. The 30-day window for Heritage Group to appeal the denial to an Allen County court expired on June 25, 2026. No appeal was filed.

What Comes Next

The land itself is not permanently protected. Heritage Group has not acquired the parcels, but the seller has shown intent. Securing the land for conservation remains an open and urgent priority. Heritage Group could refile in approximately one year.

The only durable solution is making sure this land is protected for good. What that looks like is something we want to work through with this community. We will share more as those conversations develop.
